These Terms and Conditions ("Terms") constitute a legally binding agreement between you and 10X Solutions ("Company," "we," "us," or "our"), governing your access to and use of Chameleon Homes, including the mobile application, web platform, and all related services (collectively, the "Service"). By creating an account, accessing the Service, or clicking "I Agree," you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, do not access or use the Service.
1. Acceptance of Terms
By accessing or using the Service, you represent that: (a) you have read and agree to these Terms; (b) you are at least 18 years of age; (c) you have the authority to enter into this agreement on behalf of yourself or, if applicable, your organization; and (d) your use of the Service does not violate any applicable law or regulation.
We may update these Terms from time to time. We will provide at least 30 days' notice of material changes by posting the revised Terms at chameleon.homes/terms and, where appropriate, notifying registered users by email. Continued use of the Service after the effective date of any revision constitutes acceptance of the updated Terms.
2. Service Description
Chameleon Homes is a mobile mortgage calculator SaaS platform designed exclusively for use by licensed Mortgage Loan Officers ("Pros"). The Service enables Pros to:
- Run real-time purchase mortgage scenarios for multiple loan types (Conventional, FHA, VA, USDA)
- Share interactive calculator sessions with home buyers ("Buyers") via SMS
- Capture and manage leads through the My Leads dashboard
- Collaborate with real estate agents and Buyers (Elite tier)
3. Eligibility
3.1 General Eligibility
You must be at least 18 years of age to use the Service. By using the Service you represent and warrant that you meet this requirement.
3.2 Pro Subscriber Eligibility
Access to paid Pro or Elite subscription tiers is available only to individuals who are:
- Currently licensed as a Mortgage Loan Originator (MLO) in the United States in good standing with the Nationwide Multistate Licensing System (NMLS), and
- In compliance with all applicable federal and state licensing requirements for their jurisdiction(s) of practice.
By subscribing to a paid tier, you represent and warrant that you meet the licensing requirements above. If your license lapses, is suspended, or is revoked, you must immediately cease using the Service as a Pro subscriber and notify us at support@chameleon.homes. 10X Solutions reserves the right to verify NMLS credentials and suspend accounts that do not meet eligibility requirements.
3.3 Buyer Eligibility
Buyers are home purchasers who access a shared calculator session provided by their MLO. Buyers do not create accounts and are not subject to subscription requirements. Buyers must be at least 18 years of age to use the Service.
4. Pro Subscriber Obligations
As a Pro subscriber, you are responsible for the following:
4.1 Accuracy of Information
You are solely responsible for the accuracy of all information you input into the Service, including Buyer information, loan parameters, and scenario assumptions. Chameleon Homes makes no representations as to the accuracy of any user-inputted data.
4.2 Regulatory Compliance
You agree to use the Service in full compliance with all applicable laws and regulations, including without limitation:
- The Real Estate Settlement Procedures Act (RESPA) and implementing regulations (Regulation X)
- The Telephone Consumer Protection Act (TCPA) and applicable FCC rules
- The Fair Housing Act and applicable state fair lending laws
- Your state-specific MLO licensing requirements
- The Truth in Lending Act (TILA) and applicable disclosure requirements
4.3 No Mass Marketing
The Buyer SMS invite feature is designed for individual, specific client outreach only. You may not use the Service to send bulk or mass marketing messages, or to transmit unsolicited SMS to individuals who have not provided their phone number directly to you.
4.4 Login Credentials
Your account credentials are personal and non-transferable. You may not share your login credentials with any other person. You are responsible for all activity occurring under your account. You agree to notify us immediately of any unauthorized access or suspected security breach.
4.5 Referral Codes
Referral codes issued to Pro subscribers are personal and non-transferable. You may not sell, auction, or transfer referral codes to third parties. Any account found to be abusing the referral system may be suspended or terminated.
4.6 Team Management (Elite)
If you use the MyTeam feature, you are responsible for ensuring that all team members and real estate agents added to your account also comply with these Terms and applicable laws, including Fair Housing requirements.
5. SMS Messaging and TCPA Compliance
5.1 Buyer SMS Invites
The Service allows Pros to send a single SMS message to a Buyer's phone number to invite that Buyer to view a shared calculator session. The Buyer's phone number must be provided to the Pro verbally or in person by the Buyer. By entering a Buyer's phone number into the Service and initiating an invite, you represent and warrant that:
- The Buyer has provided their phone number directly to you with knowledge that you may use it to send them a link to access their mortgage calculator session;
- You have not obtained the phone number from a purchased list, web database, or any source other than direct communication with the Buyer; and
- The use of that phone number complies with TCPA and all applicable state telecommunications laws.
5.2 Opt-Out
Buyers may opt out of further SMS from Chameleon Homes at any time by replying STOP to any message received. Upon receipt of a STOP message, Chameleon Homes will cease further SMS to that number. Carrier message and data rates may apply.
5.3 A2P 10DLC Registration
All SMS sent by the Service are transmitted via a registered A2P 10DLC phone number. Chameleon Homes is not responsible for carrier-level delivery failures, delays, or filtering of SMS messages.
5.4 Pro Indemnification for TCPA Violations
You agree to indemnify and hold harmless 10X Solutions from any TCPA claims, penalties, or liabilities arising from your entry of a Buyer's phone number without proper authorization, as further described in Section 11.
6. Trial and Subscription Terms
6.1 Free Trial
New users are entitled to a 14-day free trial of the Pro tier upon creating an account. No payment information is required to begin the trial. The free trial provides access to all Pro-tier features during the trial period. Each user is entitled to one free trial per account; trial benefits are non-transferable.
6.2 Subscription Plans
After the trial period, continued access to the Service requires a paid subscription. The following plans are available:

All subscription fees are billed in advance for the applicable billing period (monthly or annual) using the payment method on file. Subscriptions automatically renew at the end of each billing period unless cancelled.
6.3 After the Trial
If you do not subscribe before the expiration of your 14-day free trial, access to the Service will be suspended until a paid subscription is activated. No data will be deleted within 30 days of trial expiration; after 30 days, account data may be removed in accordance with our Privacy Policy.
6.4 Price Changes
We reserve the right to change subscription prices with at least 30 days' advance notice, communicated via email to registered users and posted at chameleon.homes/services. Price changes take effect at your next renewal date after the notice period.
6.5 Refunds
Refunds are governed exclusively by our Refund Policy, which is incorporated into these Terms by reference.
7. Intellectual Property
All content, code, designs, trademarks, service marks, trade names, logos, features, and functionality of the Service — including but not limited to the Chameleon Homes name, brand identity, mobile application, algorithms, databases, and documentation — are the proprietary intellectual property of 10X Solutions and are protected by United States and international copyright, trademark, patent, and trade secret law.
Subject to your compliance with these Terms, 10X Solutions grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose. This license does not include the right to sublicense, sell, resell, transfer, assign, modify, adapt, translate, create derivative works, reverse engineer, disassemble, or decompile any part of the Service.
Your account data (calculator inputs, Buyer contacts) remains your data. You grant 10X Solutions a limited license to use such data solely to operate and improve the Service.
8. Prohibited Uses
You agree not to use the Service to:
- Originate, broker, or commit to any mortgage loan without a valid license to do so
- Discriminate against any person in violation of the Fair Housing Act, Equal Credit Opportunity Act, or any other anti-discrimination law based on race, color, national origin, religion, sex, familial status, disability, or any other protected class
- Collect, extract, harvest, or systematically download data from the Service using automated tools, bots, scrapers, or crawlers
- Impersonate another person, including another licensed MLO, or provide false or misleading NMLS credentials
- Use another user's login credentials without authorization
- Upload or transmit malicious code, viruses, or any software intended to damage or interfere with the Service
- Attempt to gain unauthorized access to any portion of the Service, its servers, or associated infrastructure
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Sell, resell, or sublicense access to the Service without our express written consent
- Use the SMS invite feature for mass marketing, spam, or any purpose other than inviting a specific, identified Buyer to view their individual calculator session
Violation of any prohibition in this section may result in immediate suspension or termination of your account and may give rise to civil or criminal liability.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. To the fullest extent permitted by applicable law, 10X Solutions expressly disclaims all warranties, express, implied, or statutory, including without limitation:
- Any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement
- Any warranty that the Service will be uninterrupted, error-free, secure, or free of viruses
- Any warranty as to the accuracy, completeness, or reliability of any calculator outputs, estimates, or other results generated by the Service
All mortgage calculations and estimates are for informational purposes only. They do not constitute a loan commitment, pre-approval, pre-qualification, or guarantee of any lending terms. Actual loan terms, rates, fees, and approvals are determined by the lending institution and may differ materially from any estimate provided by the Service. Neither Pros nor Buyers should rely on Service outputs as a substitute for advice from a licensed lender, financial advisor, or attorney.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL 10X SOLUTIONS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, revenue, business, data, goodwill, or anticipated savings
- Any damages arising from reliance on any calculator output or estimate generated by the Service
- Any lending decision, loan denial, rate lock failure, or other mortgage outcome related to the use of or inability to use the Service
- Any unauthorized access to or alteration of your data
These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if 10X Solutions has been advised of the possibility of such damages.
10.1 Maximum Liability — Pro Subscribers
10X Solutions' maximum aggregate liability to any Pro subscriber for any claims arising from or related to the Service shall not exceed the total subscription fees paid by that subscriber during the three (3) months immediately preceding the event giving rise to the claim.
10.2 Maximum Liability — Buyers
10X Solutions' maximum aggregate liability to any Buyer arising from or related to the Service shall not exceed fifty U.S. dollars ($50.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages; if such laws apply to you, some of the above limitations may not apply.
11. Indemnification
You agree to indemnify, defend, and hold harmless 10X Solutions and its officers, directors, employees, agents, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms
- Any TCPA claim arising from your entry of a Buyer's phone number without proper consent or authorization
- Any RESPA violation arising from your use of the Service
- Your violation of any licensing law or regulation applicable to your practice as an MLO
- Any Fair Housing Act violation or discriminatory conduct in your use of the Service
- Your negligent or wrongful acts or omissions in connection with your use of the Service
- Your infringement of any third-party intellectual property rights through content you submit to the Service
We reserve the right to assume exclusive control of the defense of any matter subject to indemnification by you, in which event you agree to cooperate with us in asserting any available defenses at your expense.
12. Termination
12.1 Termination by 10X Solutions
We may suspend or terminate your access to the Service immediately, without prior notice or liability, if:
- You materially breach these Terms and fail to cure the breach within 7 days of written notice (or immediately if the breach is incurable)
- We determine, in our reasonable judgment, that you are not a licensed MLO or have misrepresented your credentials
- Your account is associated with fraudulent activity, TCPA violations, or other illegal conduct
- We are required to do so by law or regulatory authority
12.2 Cancellation by User
You may cancel your subscription at any time through your account settings or by contacting support@chameleon.homes. Cancellation takes effect at the end of the current billing period. Refunds are governed by our Refund Policy.
12.3 Effect of Termination
Upon termination, your license to use the Service is immediately revoked. Sections 7, 9, 10, 11, 13, and 14 of these Terms survive termination. We will retain and delete your data in accordance with our Privacy Policy.
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
13.2 Venue
Any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in California, and you consent to personal jurisdiction and venue in those courts.
13.3 Class Action Waiver
YOU AND 10X SOLUTIONS EACH WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR COLLECTIVE PROCEEDING OF ANY KIND. All disputes must be brought individually. If this waiver is found unenforceable with respect to any particular dispute, that dispute shall be severed and resolved individually; all other disputes shall remain subject to this waiver.
13.4 Limitation Period
Any claim or cause of action arising from or related to the Service or these Terms must be filed within one (1) year after the claim arose. Claims not filed within this period are permanently barred, to the fullest extent permitted by applicable law.
13.5 Informal Resolution
Before filing any formal legal claim, you agree to first contact us at support@chameleon.homes and attempt to resolve the dispute informally for at least 30 days. This requirement does not apply to requests for injunctive or other equitable relief.
14. General Provisions
14.1 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions will continue in full force and effect.
14.2 Waiver
No failure or delay by 10X Solutions in exercising any right under these Terms will constitute a waiver of that right. Any waiver must be in writing and signed by an authorized representative of 10X Solutions.
14.3 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, sale of assets, or operation of law.
14.4 Force Majeure
10X Solutions will not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, pandemic, war, civil unrest, labor disputes, government actions, power or internet outages, or third-party infrastructure failures.
14.5 Electronic Communications
You consent to receive communications from us electronically, including by email and in-app notifications. You agree that such electronic communications satisfy any legal requirement that communications be in writing.
14.6 Entire Agreement
These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and 10X Solutions with respect to the Service, superseding all prior and contemporaneous agreements, understandings, and representations.
